Terms of Service & Privacy Statement

1. Introduction

Welcome to Krung Thiu-tat. This website is operated by Performalytics, a Dutch Sole Proprietorship (Eenmanszaak). When you book with us, you are valuing transparency, functionality, and local authenticity. These terms reflect that.

2. How Booking Works

We manage units on behalf of private owners. When you book through this site, Performalytics facilitates the transaction and manages your stay.

2.1 Payments

We use Stripe to process payments securely. We do not store your credit card details.

Payment Schedule:

  • Stays of 45 days or less: 100% of the rental fee is required upfront at the time of booking.
  • Stays of more than 45 days: The first 30 days are charged upfront to secure your dates. The remaining balance will be charged in monthly installments via Stripe.

2.2 No Security Deposit

We operate on trust (“Your Word is your Deposit”). We do not charge a monetary security deposit upfront. However, by booking, you agree that you remain financially liable for any damages to the unit or missing inventory beyond normal wear and tear, as detailed in your Rental Contract.

2.3 The Rental Contract

Your stay is subject to local law and the specific regulations of the condominium. Before check-in, you will be required to sign our Standard Rental Contract.

3. Cancellation & Refunds

Our policy is designed for long-term planning. It is firm but fair.

  • 30+ Days Before Arrival: Full Refund. If plans change, let us know at least 30 days out, and we will refund 100% of your money.
  • Less Than 30 Days Before Arrival: Non-Refundable. The first 30 days of your booking are forfeited. If you booked longer than a month, the remaining balance (days beyond the first 30) will be refunded.
  • Early Departure: If you choose to leave earlier than your booked dates, the unused nights are non-refundable.

4. Utilities & Usage

  • Fair Use Policy: Your rate includes a generous electricity allowance as specified in your Rental Contract. This covers normal A/C usage (e.g., nights and work hours).
  • Excess Usage: If usage exceeds the allowance defined in your contract (e.g., leaving A/C on with windows open), we will charge the difference at the standard government rate. You will receive a payment link for any overage.
  • Internet: A private high-speed connection is included.

5. Privacy Statement

We treat your data the way we want our own data treated: securely and with minimal fuss.

5.1 What We Collect & Why

Booking Data: Name, email, and payment history. Used to process your booking and invoice you.

Identity Data (Passports):

  • Why: We are legally required by local immigration authorities (e.g., filing a TM30 Form in Thailand) to report foreign guests within 24 hours of arrival.
  • How: We take a photo or receive a copy at check-in.
  • Storage: These are stored securely on our company Google Drive.
  • Deletion: We strictly delete passport copies 30 days after your checkout. We do not sell or keep this data.

5.2 Marketing & Communications

We want to keep you in the loop, not spam you.

  • What we send: Updates on new locations (e.g., Phuket launch), availability alerts, and occasional promotions.
  • Consent: By joining our waitlist or ticking the opt-in box at checkout, you consent to these emails.
  • Opt-out: You can unsubscribe at any time via the link in the footer of our emails.

5.3 Tech Stack & Third Parties

We use a modern stack to keep the site running. Your data may be processed by these trusted providers:

  • Infrastructure: Hetzner (VPS), Mijn.host (Hosting), Google Cloud.
  • Functionality: Stripe (Payments), n8n (Automation), Cookiebot (Consent).
  • Analytics & Ads: We use Google Analytics, Hotjar, and tracking pixels from Meta (Facebook/Instagram), TikTok, and LinkedIn to understand how people use our site and to show you relevant ads.

5.4 Your Rights

You retain full control over your data. You have the right to view, correct, or request the deletion of any personal data we hold about you at any time. Simply email admin@krungthiutat.com to exercise these rights.

5.5 Cookies & Tracking

We use cookies to make this website work and to understand how you use it.

  • Essential Cookies: These are necessary for the site to function (e.g., Stripe security tokens). You cannot switch these off.
  • Analytics & Marketing: We use cookies from Google and Meta to measure traffic and show relevant ads. These are only activated if you give us permission.
  • Your Control: We use Cookiebot to manage your consent. You can change your preferences or withdraw consent at any time by clicking the small “cookie” icon at the bottom of the screen.

6. Liability & House Rules

  • Occupancy: Max 2 people per unit. Overnight guests must be registered at the lobby with a passport.
  • Smoking: Strictly prohibited inside and on balconies.
  • Legal Jurisdiction: These Terms of Service are governed by Dutch Law. However, the physical rental of the property and the Rental Contract are governed by Local Law where the unit is located.
